Agile Luminary Project Management

These Terms of Service ("Terms") govern your access to and use of Agile Luminary, a project management application designed for agile teams ("Service"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

Agile Luminary does not warrant that the Service will be uninterrupted or error-free, that defects will be corrected, or that the Service or the servers that make it available are free of viruses or other harmful components.

Agile Luminary makes no warranties or representations about the accuracy or completeness of the content provided through the Service or the content of any sites linked to the Service and assumes no liability for any errors, mistakes, or inaccuracies in content.

Limitation on Liability

IN NO EVENT SHALL AGILE LUMINARY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, (III) UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN, (IV) INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVICE, (V) BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE, AND/OR (VI) LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF THE SERVICE.

YOU SPECIFICALLY ACKNOWLEDGE THAT AGILE LUMINARY SHALL NOT BE LIABLE FOR USER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.

Copyright Policy

Agile Luminary respects the intellectual property rights of others and expects users of the Service to do the same. We will respond to notices of alleged copyright infringement that comply with applicable law and are properly provided to us. If you believe that your content has been copied in a way that constitutes copyright infringement, please provide us with the following information:

A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
Identification of the copyrighted work claimed to have been infringed
Identification of the material that is claimed to be infringing

A statement that you have a good faith belief that use of the material is not authorized

We reserve the right to remove content alleged to be infringing without prior notice, at our sole discretion, and without liability to you. We also reserve the right to terminate a user's access to the Service if they are determined to be a repeat infringer.

General

These Terms constitute the entire agreement between you and Agile Luminary regarding the Service and supersede all prior agreements and understandings. Our failure to enforce any right shall not constitute a waiver. If any provision is found invalid, the rest remain in full force and effect.

We reserve the right to modify or replace these Terms at any time. By continuing to access or use our Service after revisions become effective, you agree to be bound by the updated terms. If you do not agree, please stop using the Service.
